This is the first study, in Australia and internationally, to combine doctrinal, empirical and participatory action research methods to produce new knowledge about children’s participation in family court matters involving family violence. The project will co-produce a therapeutic practice framework with children as lived experience experts, informed by the multidisciplinary expertise of family court judicial officers and family law system professionals. It will benefit Australia by improving children’s safety, wellbeing and access to justice after parental separation; enhancing family court responses to family violence; and increasing family court efficiency via reduced risk of non-compliance with parenting orders. Project findings will be communicated widely within Australia and internationally through policy and practice briefings, training workshops and online resources for judges and practitioners, to promote a shared understanding and implementation of the framework in all courts engaging with child victim-survivors of family violence.
